Terms of Service

The gist
Rated 11 operates a reference for agents and a small catalog of curated gifts and shops. If you use it, use it responsibly. Paid access is a $5 pack of 5 occasion credits. Purchases are final. There are no refunds. Credits live on an account token held by your agent. If that token is lost, or you switch agents without taking the token, the credits stay behind.
That is the basic idea. You must read the Terms below and agree with the details before you use the site, the API, or a credit pack (whether or not you have created an account).

This document is an adaptation of the widely reused Terms of Service, itself an adaptation of the Heroku Terms of Service, which in turn is an adaptation of the Google App Engine Terms of Service. The original work has been modified under the Creative Commons Attribution 3.0 License. Neither Heroku, Inc. nor Google LLC is connected with or sponsors Rated 11.
Your agreement with Rated 11
Your use of Rated 11 is governed by this agreement (the "Terms"). "Rated 11," "we," and "us" means the operator of the Rated 11 service. The "Service" means the website at https://rated11.com, the agent brief, the API, the curated shop and gift lists, and any other software or services we offer in connection with those. "You" and "Customer" means you, and any agent acting for you.
To use the Service, you must agree to the Terms. We treat your use of the Service, your check of the Stripe terms box, or a payment completed by your agent (including with a Shared Payment Token) as acceptance of the Terms from that point on.
We may change the Terms from time to time. You may reject the changes by stopping use and not buying further packs. If you use the Service after the Terms change, we treat that as acceptance of the updated Terms.
Your account
- You may not use the Service if you are barred from receiving it under the laws of the United States or the country where you live or from which you use the Service.
- You must be at least 18 years old to buy a credit pack.
- You must be a human, or an agent acting on a human's instructions. Accounts created only to abuse the Service are not permitted.
- Your Rated 11 account is the account id and bearer token minted at account creation. We store a hash of the token, not a login. That token is the unique id. We do not recognize ChatGPT, Claude, Grok, Copilot, Gemini, or any other host as you.
- You (or your agent) must keep the token. Credits, the first free occasion, and purchase history belong to that account. Switching agents without giving the new agent the token means those credits cannot be redeemed there.
Use of the Service
- Your use of the Service must comply with applicable laws.
- You agree not to interfere with or disrupt the Service.
- We may enforce quotas and usage limits (including the daily cap on new occasions) with or without notice.
- You may not share an account or access the Service in a way intended only to avoid fees.
- You may not scrape, bulk-export, or republish the curated shop list or gift corpus. First-pass returns a filtered set for a specific occasion. That is the access we sell.
Service policies and privacy
Rated 11 has no access to, and does not retain, any details you share with your agent in conversation. What that agent stores, forgets, or shares with its own provider is between you and the agent. We do not control it and we make no promise about it.
If you use the catalog, we store only what we need to bill and enforce a credit: an account id, a token hash, and the occasion key (normalized recipient, occasion type, and date). First-pass queries are used to filter shops and the corpus for that call. Payment is processed by Stripe.
Fees for use of the Service
- Interviewing, reminders, open-web search, and planning the day do not require a credit. The first new occasion on an account may use the catalog without charge.
- Further structured catalog search (shops, then corpus) uses occasion credits. A pack is $5.00 USD for 5 credits. Credits do not expire. One credit opens one normalized occasion (recipient, type, and date). Follow-ups on that same key do not spend another credit.
- Payments are non-refundable. There will be no refunds or credits for unused occasions, a lost token, a switched agent, a change of mind, a thin catalog result, or partial use of a pack. The price is small and we do not offer purchase support.
- All fees are exclusive of taxes you may owe. You are responsible for those taxes.
- Card and billing information you give at checkout is handled by Stripe, our payment processor, to effect payment and service the charge.
- We may change fees by updating the Service and these Terms. A change does not apply to credits you already bought.
Cancellation and termination
- You may stop using the Service at any time. Unused credits are not refunded.
- We may, in our discretion and for any or no reason, suspend or terminate an account, including for abuse of the API or these Terms. We may do so without prior notice and we will not be liable to you or any third party for that termination.
Your content
We claim no ownership of what you tell your agent. That content is yours (or your agent's to hold). We do not keep it, except the billing fields described above.
You are responsible for how your agent stores the token and any notes. We are not responsible if an agent forgets the token, a chat is deleted, or a third-party host loses memory.
Ideas and feedback
If you send comments or ideas about the Service, you agree the disclosure is unsolicited and without restriction, and that we may use the idea without compensation to you.
Modification of the Service
- You acknowledge that the Service may change from time to time without prior notice, including fees, security patches, added or removed functionality, and other enhancements or restrictions.
- We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
External resources
The Service may link to other sites, shops, and resources, including third-party gift guides and retailers. We are not responsible for their availability and do not endorse their advertising or products. Buying from those shops is between you and them.
License from Rated 11 and restrictions
Rated 11 gives you a personal, worldwide, royalty-free, non-assignable, non-exclusive license to use the Service as we provide it, for the sole purpose of using the Service in the manner permitted by the Terms. Access to the catalog is a license to query it for your occasions, not ownership of the list.
You may not (and you may not permit anyone else to): (a) copy, modify, create a derivative work of, reverse engineer, decompile, or otherwise attempt to extract the source code or the full catalog of the Service, unless this is expressly permitted or required by law; or (b) attempt to disable or circumvent any security mechanisms used by the Service.
Open source licenses for components of the Service are separate written agreements. To the limited extent those licenses expressly supersede these Terms, they govern your use of those components.
Exclusion of warranties
- You expressly understand and agree that your use of the Service is at your sole risk and that the Service is provided "as is" and "as available."
- We have no responsibility or liability for deletion or failure to store a token, credits, or communications. You are solely responsible for keeping the token.
- We do not warrant that: (a) the Service will meet your requirements, (b) use will be uninterrupted, timely, secure, or free from error, (c) results or catalog matches will be accurate or complete, (d) quality will meet your expectations, or (e) any errors will be fixed.
Limitation of liability
You expressly understand and agree that Rated 11, its affiliates, and its licensors shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages which may be incurred by you, however caused and under any theory of liability. This includes any loss of profit, goodwill, data, cost of substitute goods or services, or other intangible loss (whether or not we have been advised of the possibility). If a court nonetheless finds us liable, our total liability will not exceed the amount you paid us in the twelve months before the claim, or $5, whichever is greater.
Indemnification
You agree to hold harmless and indemnify Rated 11 and its officers, agents, and partners from any third-party claim arising from (a) your breach of the Terms, (b) your use of the Service, or (c) your violation of applicable law, including claims, losses, damages, suits, judgments, and attorneys' fees.
General legal terms
The Terms constitute the whole legal agreement between you and Rated 11 and govern your use of the Service. They replace any prior agreements relating to the Service.
If we do not exercise a right in the Terms, that is not a waiver. Those rights remain available.
We shall not be liable for failing or delaying performance resulting from any condition beyond our reasonable control, including governmental action, acts of terrorism, earthquake, fire, flood or other acts of God, labor conditions, power failures, and Internet disturbances.
The Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules. You agree that courts located in King County, Washington have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction.
You may not assign these Terms without our prior written consent. We may assign them as part of a reorganization or sale of the Service.
